Terms of Use

These terms of use apply to your use of the Ruxsy mobile application (iOS / Android — hereafter the "App"), provided by Avena Ruxsy Global Private Limited. If you object to anything in these terms or our privacy policy, please do not use the App.

Acceptance of Terms

By using the App, you agree to be bound by these Terms of Use. We reserve the right to make changes at any time. Continued use of the Ruxsy app after any revision indicates your acceptance of the updated terms. Ruxsy shall not disclose your contact information to any third party, except as required by applicable law.

Eligibility

• You are at least 18 years or older; at least 18 years for females and 21 years for males for the purposes of marriage.
• You can form a binding contract with Ruxsy
• You are not in violation of any applicable laws
• We are entitled to remove your account permanently if any of the above conditions are not met
• You are not a citizen of any country other than India

Governing Law

These terms and privacy policy shall be governed by the laws of India. You agree to submit to the exclusive jurisdiction of the courts in Bangalore, Karnataka.

Registration and Your Account

• To use the App, you must register using your mobile number and create a personal account.
• You accept sole responsibility for all activities that occur under your login credentials.
• By registering for Ruxsy, you grant us permission to send you SMS notifications about your profile activities.
• If you feel your account has been compromised, contact us immediately from your registered mobile number.

Community Guidelines

• You will not post or transmit defamatory, abusive, obscene, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material.
• You will not use automated tools to retrieve, index, data mine, or reproduce any part of our service.
• You agree not to access or use the App through any VPN or proxy server. Upon detection, Ruxsy reserves the right to immediately suspend or terminate your account without notice or refund.
• You will not use the Ruxsy app for soliciting business activities or commercial purposes.
• You will not provide inaccurate, misleading or false information.
• You will not publish links to other websites or share your Ruxsy login with another person.
• You may not publish any personal contact information on your Account.
• Your photos will be reviewed before being published on Ruxsy.
• You will not upload viruses or malicious code or compromise the security of the services.
• You will immediately cease contacting any user who asks you to stop.

Safety

The company currently does not conduct criminal or formal background checks of all users. You are solely responsible for taking appropriate safety precautions. All content and services are provided on an "as is" and "as available" basis. Ruxsy shall not collect data from minors. Should a member fraudulently claim to be over 18, parents should inform Ruxsy by email requesting deletion.

Purchases, Cancellations & Refunds

Since Ruxsy does not sell physical goods, there is no concept of cancellation or return of purchases. Digital goods include Messages and VIP subscriptions. For the first 10,000 subscribers, a Premium Subscription Plan is available at a discounted one-time fee of INR 4,444. This provides unlimited likes and unlimited messages for four (4) years from activation. This offer is non-transferable and non-refundable once purchased. As a general rule, all payments are final and non-refundable.

License

The rights granted by Ruxsy to the user are restricted to private and personal use. As a user, you grant Ruxsy a free-of-charge, non-exclusive, international and permanent license for use, reproduction, representation, modification and translation of any intellectual property you provide through the App for communicating with other users on Ruxsy.

Deletion of Account

A user may decide at any time to delete their account. If they wish to use Ruxsy again, they will be required to register once again. Their profile will be removed from the list of profiles and cannot be reactivated.

Limitation of Liability

• You are solely responsible for your interactions with other Ruxsy users.
• In no event shall Ruxsy be liable for any damages whatsoever arising out of or relating to the conduct of you or anyone else in connection with the use of the service.
• Ruxsy's maximum liability, regardless of cause of action, will not exceed the fees you have paid to make purchases on Ruxsy.

Indemnity

To the full extent permitted under Indian laws, you agree to defend, indemnify and hold harmless Ruxsy, its officers, directors and employees from and against all liabilities, demands, claims, damages, losses, costs, and expenses arising out of or relating to your access to or use of the services or your breach of this agreement.

Miscellaneous

• Ruxsy can be acquired for a part or in whole by another company, possibly without notice.
• If any part of these terms is found to be void, the other provisions shall continue to apply.
• We reserve the right to make changes to the terms of use and privacy policy at any time.
